Chapter 1 General Provisions

Article 4: The acts of espionage referred to in this Law refer to the following acts:

Chapter 3 Investigation and Disposal

Article 23: National security organs shall exercise their powers and duties stipulated in this Law and relevant laws in accordance with the law in counterintelligence work。

Article 33: Possible harm to national security after leaving the country，Or Chinese citizens who have caused significant losses to national interests，The national security department of the State Council may decide not to leave the country within a certain period，And notify the immigration management agency。

For persons suspected of espionage，National security agencies at or above the provincial level may notify the immigration management agency not to allow them to leave the country。

Article 34: Overseas personnel who may engage in activities endangering the national security of the People’s Republic of China after entering the country，The national security department of the State Council may notify the immigration management agency not to allow entry。

Article 35: Persons not allowed to leave or enter the country as notified by the national security agency，Immigration management agencies shall implement it in accordance with relevant national regulations；No exit allowed、The entry status has disappeared，National security organs should promptly revoke the ban on leaving the country、Entry decision，And notify the immigration management agency。

Article 38 Violations of the provisions of this law，Suspected crime，Need to identify whether relevant matters are state secrets or intelligence and need to assess the harmful consequences，By the national confidentiality department or the province、Autonomous Region、The municipal confidentiality department shall conduct identification and organizational assessment within a certain period of time in accordance with procedures。

Article 39: Investigation by national security agencies，Discovered that espionage is suspected of being a crime，The case should be opened for investigation in accordance with the provisions of the "Criminal Procedure Law of the People's Republic of China"。

Chapter 4 Guarantee and Supervision

Article 40: National security agency staff perform their duties in accordance with the law，Protected by law。

Article 45: National security agencies are required for counterintelligence work，According to relevant national regulations，Can be submitted to customs、Immigration management and other inspection agencies provide customs clearance convenience for relevant personnel，Relevant information、Equipment, etc. are exempted from inspection。Relevant inspection agencies shall provide assistance in accordance with the law。

Article 46: Staff members of national security organs performing tasks，Or for individuals assisting in the execution of counterintelligence tasks，When the personal safety of yourself or your close relatives is threatened，National security organs shall, in conjunction with relevant departments, take necessary measures in accordance with the law，Protect、Rescue。

Chapter 5 Legal Liability

Article 59 Violation of the provisions of this law，Refuse to cooperate with data retrieval，Penalized by the national security agency in accordance with the relevant provisions of the "Data Security Law of the People's Republic of China"。

Article 60 Violation of the provisions of this law，Have one of the following behaviors，Constituting a crime，Pursuing criminal responsibility according to law；Not yet a crime，A warning or administrative detention of not more than ten days by the national security agency，A fine of not more than 30,000 yuan may be imposed:

(1) Leaking state secrets related to counterintelligence work;

(3) Deliberately obstructing national security organs from performing their tasks in accordance with the law;

(6) Support according to law、Retaliation against individuals and organizations that assist national security agencies。

Article 62: Seizures by national security agencies in accordance with this law、Seizure、Frozen property，Should be kept properly，And handle it according to the following situations:

(1) Suspected of committing a crime，Processed in accordance with the provisions of the "Criminal Procedure Law of the People's Republic of China" and other relevant laws；

Article 65: Fines and confiscated property collected by national security agencies in accordance with the law，All will be turned over to the national treasury。

Article 66 Overseas personnel violating this law，The national security department of the State Council may decide to leave the country within a time limit，And decide the period of inadmissibility。Failure to leave the country within the prescribed period，Can be deported。

For overseas persons who violate this law，Deportation decided by the national security department of the State Council，Not allowed to enter the country within ten years from the date of deportation，The penalty decision of the national security department of the State Council is final。

Article 67 Before the national security agency makes a decision on administrative punishment，The parties shall be informed of the content and facts of the proposed administrative penalty、Reason、Based on，And the parties’ legal entitlement statements、Defence、Rights to request a hearing，And implemented in accordance with the relevant provisions of the "Administrative Punishment Law of the People's Republic of China"。
